This paper advances a new paradigm in clinical ethics education that not only emphasizes development of individual cli but also focuses on the institutional context within which health care professionals work. This approach has been applied to the goal of improving the care provided to critically and terminally ill adults. The model has been adopted by about thirty hospitals and nursing homes; additional institutions will soon join the program, entitled Decisions Near the End of Life. Die vorliegende Analyse setzt sich mit dem Vorwurf der gesellschaftlichen Irrelevanz von Peter Handkes Prosa auseinander. Anhand einer vergleichenden Interpretation von R. M. Rilkes Malte und P. Handkes Stunde soll die Unhaltbarkeit dieser These unter Beweis gestellt werden, insofern sich die Ich-Orientierung bei Handke im Gegensatz zu Rilkes letztlich streng solipsistischer Attitüde als eine im Gegeneffekt doch im Sozialbereich verankerte Subjektivität enthüllt.

Die vorliegende Studie unternimmt den Versuch, Gadamers Ideen zur Begriffsbildung und Textbedeutung einer rationalen Rekonstruktion im Licht neuerer Entwicklungen in der linguistischen und philosophischen Semantik zu unterziehen. Anschließend an eine Kritik gewisser auf Heidegger zurückgehender Annahmen in Gadamers Wahrheit und Methode werden seine Begriffe der Applikation und der Geschichtlichkeit von Textbedeutungen reformuliert. Dies geschieht unter Bezugnahme auf J. J. Katz' Bedeutungs- und Referenztheorie, H. Putnams Theorie der Stereotypen und J. M. E. Moravcsiks Begriff der 'aitiational frames'. Es wird im besonderen (...) die These vertreten, daß Gadamers Idee der Interpretation als eines Prozesses, bei dem Autor und Leser zu einer Übereinkunft über die 'Sache' kommen , neu und fruchtbar in Begriffen der Interaktion zwischen semantischer Kompetenz und Alltagswissen im Leseprozeß überdacht werden kann. In Verbindung mit weiteren Teilen linguistischer Theorie würde ein solcher Neuansatz es ermöglichen, die Frage zu beantworten wie Verstehen im Prinzip möglich ist. Eine rationale Rekonstruktion von Gadamers Begriff der Applikation in dieser Richtung würde es ferner erlauben, Antworten auf eine Reihe weiterer schwieriger Fragen wie zum Beispiel der nach dem Grad der Unbestimmtheit von Textbedeutungen und der 'Korrektheit' von Interpretationen zu erhalten. This paper is an exposition as well as a critical examination of M. Frank's response to the Derrida/Searle debate. It argues that Frank's critique of Derrida and Searle is partly justified but suffers from a number of shortcomings. The author agrees with Frank's argument that Derrida fails to explain how linguistic meaning is possible on the basis of purely differential relations between signs (différance) and supports his view that the human subject, in spite of its lack of complete self-transparency, is (...) endowed with more autonomy and semantic creativity than Derrida is willing to grant it. The paper tries to show, however, that much of Frank's critique of linguistic theory as represented by the work of Searle is unjustified because it is informed by a questionable notion of linguistic determinism rooted in Schleiermacher and Saussurean structuralism, a notion of ineffable or non-conceptual individual meaning that remains insufficiently explicated, and a generally anti-naturalist attitude towards language which leads to a misunderstanding of the role linguistics and related cognitive sciences can (and cannot) play in the hermeneutic sciences. This book is best understood if one places it into the specific context of present-day debates about the shortcomings of American liberalism. With Alasdair MacIntyre and other communitarians on the one hand, and the "new constitutionalist right" on the other hand, mainstream liberalism in the United States reaching from Dewey to Rawls appears to be under pressure. Macedo does his best to salvage it without relying on support from left-wing communitarians or moderate defenders of social democracy such as Charles Taylor (...) or M. Walzer. The title "liberal virtues" is, after all, almost provocative; at least we begin to hear it that way, having become accustomed to separating virtue from liberalism and attributing an almost premodern meaning to the term virtue. Therefore Macedo puts much effort into a reconstruction of the historical ancestry of American liberalism and shows that liberalism was integral to the constitutional history of the United States. He takes his argument through a consideration of a number of relevant Supreme Court decisions, all the while clearly recognizing that republican and democratic virtues have sources other than those available through constitutional adjudication. What interests the author is the relation between the public virtues of reasonableness, tolerance, critical reflection as moral virtues and their legal counterparts. He thus makes a case for a liberal public morality or ethos, without which political liberalism or liberalism in constitutional law cannot overcome a "shortfall of legitimacy and moral justification". Die Studie unterscheidet sich durch die Konzentration auf die spezifisch natur- bzw. vernunftrechtlichen Lehrstücke des Strafrechts von entsprechenden Forschungen in den benachbarten Disziplinen wie der Strafrechtsgeschichte oder den Kulturwissenschaften. Die Untersuchung hat gezeigt, dass die Strafrechtsphilosophie der neuzeitlichen Naturrechtslehre ein Ergebnis einer Anwendung säkularer Prinzipien auf das Problemfeld staatlicher Strafe ist. Behandelt werden die strafrechtstheoretischen Überlegungen von Grotius, Hobbes, Pufendorf, Wolff, Beccaria und Kant im Hinblick auf die Frage nach dem Ursprung bzw. Geltungsgrund der Strafkompetenz und dem Strafzweck (Abschreckung, Besserung (...) oder Vergeltung). Darüber hinaus werden die Gründe der Affinität der Strafrechtstheorie zu deterministischen psychologischen Modellen sowie die Kritik der kriminalpolitischen Aufklärung an der Strafpraxis des Ancien Régime untersucht. Weil die Naturrechtslehrer im 17. und 18. Jahrhundert in erster Linie an der philosophischen Rechtfertigung der Strafe bzw. der Legitimation der staatlichen Strafgewalt interessiert sind, spielen die soziologischen oder gesellschaftstheoretischen Aspekte der Kriminalität bei ihnen kaum eine Rolle. Die Naturrechtstheoretiker interessieren sich m. a. W. nur für die Geltungsbedingungen des Strafrechts, während die Fragen der Genesis kriminellen Verhaltens weitgehend ignoriert werden. Aber gerade die Konzentration des Blicks auf die spezifisch rechtsphilosophischen Argumetationen eröffnet einen neuen Blick auf die Strafrechtsphilosophie der Aufklärungsepoche. (shrink)

: The aim of the present paper is to discuss how the legal metaphors in Kant’s Critique of Pure Reason can help us understand the work’s transcendental argumentation. I discuss Dieter Henrich’s claim that legal deductions form a methodological paradigm for all three Critiques that exempts the deductions from following a stringent logical structure. I also consider Rüdiger Bubner’s proposal that the legal metaphors show that the transcendental deduction is a rhetorical argument. On the basis of my own reading (...) of the many different uses of legal analogies in the first Critique, I argue that they cannot form a consistent methodological paradigm as Henrich and Bubner claim. Several debates of the last years within the research field of contemporary realism – known under titles such as "New Realism," "Continental Realism," or "Speculative Materialism" – have shown that science is not systematically the ultimate measure of truth and reality. This does not mean that we should abandon the notions of truth or objectivity all together, as has been posited repeatedly within certain currents of twentieth century philosophy. However, within the research field of contemporary realism, the concept of objectivity (...) itself has not been adequately refined. What is objective is supposed to be true outside a subject’s biases, interpretations and opinions, having truth conditions that are met by the way the world is. The volume combines articles of internationally outstanding authors who have published on either Idealism, Epistemic Relativism, or Realism and often locate themselves within one of these divergent schools of thought. As such, the volume focuses on these traditions with the aim of clarifying what the concept objectivity nowadays stands for within contemporary ontology and epistemology beyond the analytic-continental divide. This study described the relationships between academic class and student moral sensitivity and reasoning and between curriculum design components for ethics education and student moral sensitivity and reasoning. The data were collected from freshman (n = 506) and senior students (n = 440) in eight baccalaureate nursing programs in South Korea by survey; the survey consisted of the Korean Moral Sensitivity Questionnaire and the Korean Defining Issues Test. The results showed that moral sensitivity scores in patient-oriented care and conflict were (...) higher in senior students than in freshman students. Furthermore, more hours of ethics content were associated with higher principled thinking scores of senior students. Nursing education in South Korea may have an impact on developing student moral sensitivity. Planned ethics content in nursing curricula is necessary to improve moral sensitivity and moral reasoning of students. (shrink)

There is a consensus that satire cannot be defined, but is best characterized by a cluster account. However, I argue that a cluster account does not acknowledge the artistically and politically significant distinction between real satire and some forms of frivolous topical comedy which are casually labeled ‘satire’ in international media contexts. To uphold this distinction, I introduce a weak proposal that satire is a genre which necessarily sets out to critique and entertain (with the qualification that these purposes necessarily (...) interact, although neither is wholly instrumental to the other). I further argue that this proposal also provides necessary and sufficient conditions for a definition of satire. (shrink)

Irony has a suspicious moral reputation, especially in popular media and internet culture. Jonathan Lear (2011) introduces a proposal which challenges this suspicion and identifies irony as a means to achieve human excellence. For Lear, irony is a disruptive uncanniness which arises from a gap between aspiration and actualisation in our practical identity. According to Lear, such a disruptive experience of ironic uncanniness reorients us toward excellence, because it passionately propels us to really live up to that practical identity. However, (...) Lear’s understanding of irony is idiosyncratic and his proposal overlooks that disruption often results from value incompatibility between different practical identities. The disruption which follows from value incompatibility does not inherently reorient us toward excellence. The point is exactly that achieving excellence in one practical identity is sometimes incompatible with excellence in the other. Pace Lear, I do not identify this disruptive experience as a central example of irony. Instead, I consider irony a virtuous coping strategy for such disruption, because it introduces the necessary distance from our moral imperfection to sustain practical deliberation and maintain good mental health. Such virtuous irony negotiates a golden mean between too little disruption (complete insensitivity toward one’s imperfection) and too much disruption (a complete breakdown of practical deliberation and mental health). I argue that ironic media in popular culture provide a rich source of such virtuous irony, which I demonstrate through analysis of satirical examples. (shrink)

Den an den gewaltigen Umwälzungen unserer Zeit Interessierten bewegen heute in erster Linie die Probleme des sozialen Wandels - oder besser des dringend not wendigen Umbaus unserer Welt. Erst dahinter tritt seit einiger Zeit die Forderung nach dem Umbau des Menschen auf 1. Sie ist von der öffentlichkeit noch relativ wenig beachtet und offenbar als unangenehm fast tabuiert. Von den die Frage initiierenden Biologen ist diese Forderung aber durchaus ernst gemeint. Ihre Ten denz ist radikal. Außerhalb dieser Tendenz laufen aber (...) bereits unentwegt Prozesse, die zuerst Eingriff in die Physis und Psyche des Menschen, dann eben doch schon Veränderung bedeuten oder bedeuten können. Der Massenausstoß von Chemikalien bis ins Trinkwasser und in die Zahnpasta hinein und die permanente massenhafte Massenbeeinflussung teilgeplanter Art, zum Beispiel durch Werbung, deren Wirkung (besonders insgesamt!) völlig unbekannt ist, ist damit gemeint. Hier setzt unser Interesse ein. Die Idee einer Veränderung des Menschen ist einmal überhaupt bewegend. Zum anderen gilt ihr deshalb unser Fachinteresse, weil eine an der Kulturanthropologie und der sogenannten Philosophischen Anthropologie orientierte Soziologie durch die Behauptung und Verbreitung des Konzeptes von der »Offenheit« und »Plasti zität«, der unbegrenzten Beeinflußbarkeit und Lernfähigkeit des Menschen, zu sammen mit einer untheoretischen Evolutionstheorie erst den Hintergrund für die Idee der Möglichkeit eines »Umbaus« des Menschen geliefert hat. Ist der Mensch total offen, nicht festgelegt, dann kann er auch beliebig angepaßt werden. (shrink)

Theodor W. Adorno’s writings are often categorized as either political, aesthetic or critical. While all of these characteristics are legitimate, it is problematic to view Adorno from only one of these angles. In fact, many literary critics consider his thoughts about literature to be simple cultural criticism, i.e., something that leaves the realm of pure scholarship by defiling the argumentation with philosophy or politics. Political theorists and philosophers, on the other hand, often view his literary concerns as superfluous. It is (...) my thesis that Adorno’s way of thinking can only be adequately understood when these categories are not seen as mutually exclusive. In order to demonstrate this point, I will concentrate on his use of the term realism which can be seen as paradigmatic for this question. (shrink)
